You would have to first prove that he took no steps whatsoever to protect his copyright.

Copyrights are not automatically void simply because you posted the image publicly.

However, by displaying the image, of his own free will, on this website, it could be bumumed that he was granting limited use of said image to this website and its owner. And considering that there is no current record of this image having been used, he has a very weak case.

So, he does have a weak case, but not for the reasons you stated.
