So my ex wife got into a fight with her boyfriend, long story short, my daughter called me because she was scared I go over there, mostly because of my daughters safety not my ex’s. So I do the rational thing and bring my gun, and tell the guy too leave and tell him to never come back, or I’d kill him, so if he comes back and I have to go there again, I get sent to jail. In all seriousness he can file a restraining order against the guy, but you can plead you were defending your daugther and cancel the restraining order.
At least that’s how it works on the Brazilian law. Yes you can actually kill people if you say you were only attempting to defend yourself as long as you have a witness to back you up, but that right is negated if the jury decides your defensive acts have gone too far. Dude, I would advise you to quit incriminating yourself. You committed several actionable offenses, by your own admission. Yes it is possible that he can get a restraining order. He could even press charges, felony charges, but since the only other witness was your ex, and maybe the daughter, the charges would never fly. Leave the gun, next time. Never make a threat, especially with the gun in hand. Let your ex deal with this. No point in going to prison, or to jail (if you’re lucky). Log in to see images!
